According to the decision of the European Commission, that has led to the application of an harmonized classification, Titanium dioxide in certain powder forms (containing 1 % or more of particles with aerodynamic diameter ≤ 10 μm) is now classified as a carcinogenic substance by inhalation (H351). However, according to a press release issued by the French Ministry of Ecological Transition and Territorial Cohesion and Ministry of Energy Transition on February 13, 2023, France is appealing the decision, claiming that the EC made a mistake assessing the reliability of the study on which the classification was based on and exceeded the limits of its judicial review by conducting its own evaluation and interpretation of the scientific data.

Until the appeal is decided the harmonized classification and labelling will continue to apply.
